About the Compromise

As a result of the outpouring of public, small business and industry opposition to criminalizing the sale of metallic foil balloons, Senator Scott has agreed to modify his bill so as to not outlaw the sale of these balloons. The amended version of the bill now requires increased consumer education and warnings on the part of balloon retailers. The bill also increases the fine for selling an unweighted metallic foil balloon from $100 to $250, and specifies that weights cannot simply be a child’s toy or candy.

What Can You Do?

Over the course of the last three months, more than 7,500 California residents, retailers and small businesses have placed calls to their legislators opposing the notion of making it a crime to sell a metallic foil balloon. Balloon retailers, distributors and others had personal meetings with virtually every member of the California Legislature.
